Terms of Service - Email Verifier

1. Agreement to Terms

By accessing or using Email Verifier services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access our services.

2. Use License

Permission is granted to use Email Verifier services for personal or commercial purposes, subject to the following restrictions. You may not:

Modify or copy the materials or services
Use the materials for any commercial purpose without proper licensing
Attempt to reverse engineer any software contained in Email Verifier services
Remove any copyright or other proprietary notations from the materials
Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Email Verifier at any time.

3. Service Description

Email Verifier provides email address verification and validation services through an API. We reserve the right to modify, suspend, or discontinue the services (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the services.

4. User Obligations

As a user of Email Verifier services, you agree to:

Provide accurate, current, and complete information during registration and use
Maintain the security of your account credentials
Promptly notify us of any unauthorized use of your account
Comply with all applicable local, state, national, and international laws and regulations
Use the service only for lawful purposes and in accordance with these Terms

5. Intellectual Property Rights

The service and its original content, features, and functionality are and will remain the exclusive property of TrustPath UG (haftungsbeschränkt) and its licensors. The service is protected by copyright, trademark, and other laws of both Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

6. Limitation of Liability

In no event shall Email Verifier, TrustPath UG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the service
Any conduct or content of any third party on the service
Any content obtained from the service
Unauthorized access, use, or alteration of your transmissions or content

7. Cancellation, Refunds, and Right of Withdrawal

7.1 Right of Withdrawal for Consumers

If you are a consumer (i.e., a natural person entering into a legal transaction for purposes that are predominantly neither commercial nor self-employed), you have a statutory right of withdrawal in accordance with German law (BGB §355). Please see our Widerrufsbelehrung (Right of Withdrawal) for complete information.

Important: By requesting immediate access to our Email Verifier API service and beginning to use it, you expressly consent to the immediate provision of the digital service and acknowledge that you lose your right of withdrawal once you begin using the service, in accordance with BGB §356(5).

7.2 Subscription Cancellation

You may cancel your subscription at any time by sending an email to contact@trustpath.io or through your account dashboard. Cancellations will take effect at the end of your current billing period. You will continue to have access to the service until the end of the paid period.

7.3 Refund Policy

For Consumers exercising the right of withdrawal: If you exercise your statutory right of withdrawal within the 14-day period (and have not yet begun using the service), you will receive a full refund within 14 days of us receiving your withdrawal notice.

For subscription cancellations: No refunds are provided for partial billing periods when you cancel your subscription. Your subscription will remain active until the end of the current billing period, and you will retain access to the service during this time.

For business customers: The statutory right of withdrawal does not apply to contracts concluded for commercial or self-employed purposes. Subscription cancellations follow the policy in section 7.2 above.

7.4 How to Request a Refund

To exercise your right of withdrawal or request a refund (if eligible), please contact us at:

Include: Your account email, order date, and reason for withdrawal (optional)

We will process eligible refund requests within 14 days and use the same payment method you used for the original purchase.

8. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. API Usage and Rate Limits

Your use of the Email Verifier API is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary suspension of service or additional charges. You agree not to circumvent any rate limiting mechanisms.

12. Data Accuracy

While we strive to provide accurate email verification results, Email Verifier does not guarantee 100% accuracy. The service is provided "as is" and "as available" without warranties of any kind, either express or implied.
